Doce días estuvo retenida una lactante en el Hospital Las Higueras de Talcahuano, luego de que su madre declarara haber consumido marihuana con fines medicinales durante el embarazo. Por orden de un Tribunal de Familia, a Sindy Ortiz (27) se le prohibió amamantar a su recién nacida y llevársela a su casa, pudiendo verla solamente en el centro asistencial dos horas y media cada día.
Este protocolo sanitario que argumentó el hospital, avalado por el Ministerio de Salud, es una medida violenta y discriminatoria ya que el Estado de Chile culpa a la progenitora por no estar informada sobre las consecuencias negativas del consumo de marihuana, sin hacer entrega de la información.
Hoy las madres se informan de acuerdo a sus medios, pero no existe una política que resguarde la información, formación y libertad para tomar decisiones con responsabilidad.
Por otro lado, Leslie Power, experta en neurociencias, teoría del apego y psicoanálisis relacional, afirma que lo que hizo el Estado de Chile no se justifica por nada ya que el hábitat natural del recién nacido es el cuerpo de su madre.
También, asegura que la succión del niño al nacer no es por hambre, es por necesidad de seguridad. Los 30 minutos después del parto son claves para determinar una buena lactancia, pero las y los niños son retirados a los minutos porque el doctor tiene consulta.
Si bien, la determinación del Tribunal de Familia de Talcahuano, luego de doce días, fue permitir que la pequeña Luciana se fuera a casa con sus padres, también ordenó al Hospital Las Higueras realizar un test de drogas de manera semanal a la madre, “a fin de verificar que no existe consumo de drogas posterior a esta fecha”, continuando con la situación de violencia e inestabilidad de la madre y su hija.
